Do I Need Council Consent to Remove a Tree in Wellington?

Thinking about removing a tree on your property? Before you pick up the chainsaw, it’s important to understand your legal obligations. In many parts of the Wellington region, tree removal may require council approval — especially for large or protected trees.

When Is Council Consent Required?

Not all trees need consent to be removed. However, you’ll likely need permission if the tree:

  • Is listed as a protected or notable tree
  • Is on public land or near a boundary
  • Is within a Significant Natural Area (SNA)
  • Is over a certain size or height
  • Is covered by a covenant or development condition

Each council has its own rules, so it’s best to check with your local authority.

Wellington Region Tree Rules

Here’s a general guide, but always confirm with the relevant council:

Wellington City Council

  • Notable trees are protected under the District Plan
  • Consent is often required for removal, pruning over 20 percent, or work near the root zone
  • You may also need an arborist report

Hutt City (Lower Hutt)

  • Protection applies mainly to notable trees or trees on public land
  • Private trees may not need consent unless covered by a specific condition

Upper Hutt City

  • Trees are less regulated unless listed or on council property
  • Consent may be needed for subdivision or development-related removals

Kāpiti Coast District

  • Rules apply to protected trees or those within sensitive ecological zones
  • Native trees over a certain height or age may need consent

What About Emergency or Hazard Trees?

If a tree poses an immediate danger (e.g. storm damage, structural risk), you may be allowed to remove it without consent. However, you should still:

  • Take photos for evidence
  • Get a qualified arborist to assess the risk
  • Notify the council if required afterwards

At Advanced Arb, we provide arborist reports and assessments to support emergency or consent-related removals.
